Child Support Modification

Can I Change My Child Support Agreement After Divorce?

Yes, but there are 2 conditions that must be met. According to the Texas Attorney General, you may be allowed to modify your child support order if the following are true:

  • More than 3 years have passed since the original child support order was issued or changed and the actual child support amount differs by 20% or $100 from the amount needed.
  • A “material and substantial change” has come about since the orders were issued or changed.

A material and substantial change typically refers to a spike or dip in one parent’s income, re-marriage, new and different living arrangements, a change in the child’s health insurance, and/or one parent’s new responsibility to care for other children.

Generally speaking, it is much easier to get a desirable child support agreement during the divorce process than it is to have your child support orders favorably modified later on. However, if it becomes necessary to change your child support orders, our team at the Law Office of Bryan Fagan, PLLC is here to be your advocate.
