How will I be updated on case filings?
Clients will receive an email update of all documents filed at court.
Are virtual appointment sign-ups slower?
Virtual appointment sign-ups may delay filings due to first come, first serve. However, after your appointment, our team will process your pleadings as quickly as possible.
What information should I have prior to signing up in person or online?
Information about the parties, child issues, and property. There may be general questions asked. The intake process may be completed at the client’s convenient pace. If the client requires additional time to locate information before responding to an intake question, then pause the process and you will be able to return and complete.
How long is the uncontested divorce process?
Once the uncontested divorce is filed, 60 day must pass. We schedule for divorce to be final as soon as possible after the 60th day.
What is an uncontested divorce?
Uncontested divorce is a divorce where the parties agree on child issues and property division. Uncontested divorce means the process will not require negotiating or mediating. Uncontested divorce requires both parties to sign the Final Decree of Divorce and all required closing documents.
Will I consult an Attorney?
Attorney consultations are part of our contested divorces or paid consultations only. For uncontested divorces, an Attorney will review your documents to ensure your case meets our requirements of uncontested divorce prior to filing your case.
Is the $1450 fee the only fee?
The Uncontested Divorce Sale fee is $1450 for online sign-ups. Virtual signups require an additional fee. There is an additional fee for post-divorce matters.
Are refunds available?
At the onset of answering questions in the Client Questionnaire the Attorney is deemed earned and thus not refundable.
Are in person sign ups available?
Yes. On the First Saturday of each month, you may sign up for an Uncontested Divorce. We are located 3707 Cypress Creek Parkway, Houston, TX 77068. We will be located on the first floor, Tenant Lounge.
If I am a current client, may I convert my current case to the Uncontested Divorce Sale?
Existing Law Office of Bryan Fagan, PLLC clients may not convert their case to the Uncontested Divorce.
May I use the Uncontested Divorce Sale if I have a pending divorce?
If you are not a current Law Office of Bryan Fagan, PLLC client and have a pending case, then you cannot use the Uncontested Divorce Sale until you dismiss your pending divorce.
What if I realize the parties cannot agree, but I already paid for the Uncontested Divorce Sale?
Within the Intake questionnaire link, there is a button to send your Attorney a message. After sending the message, an Ambassador will contact you to assist with your contested divorce. The Uncontested Divorce Sale fee will be applied to you contested divorce fee.
Do I have to sign anything?
The parties will be required to provide an electronic signature to the Agreed Final Decree of Divorce. The Client will be required to execute the Prove Up Affidavit with the Firm’s online notary. The other party will be required to execute the Waiver of Service with the Firm’s online notary. The parties will receive an appointment link to schedule the online notary appointment.
