Prenuptial Agreement

A prenuptial agreement is a contract between you and your fiancé, agreed to prior to your marriage which designates how property related matters are to be handled in the event of a divorce. You and your spouse will be able to designate your desired outcomes for subjects ranging from spousal support (alimony) to bank account treatment, disability, health insurance and ownership of property are handled upon divorce.

You are required in this form to disclose all known assets and debts. Failing to do so may result in the entire agreement being declared invalid and therefore unenforceable. The Agreement will be signed by you, your fiancé, two witnesses and a notary public. It is highly recommended that you retain the services of an experienced family law attorney to help you negotiate the document as well as complete the necessary paperwork. When both you and your fiance have attorneys representing you in this process the chances for reaching an agreement that is able to hold up in court increases dramatically.
