Law Office of Bryan Fagan, PLLC (“Sponsor,” “the Firm,” “we,” or “us”)
3707 Cypress Creek Parkway, Suite 400
Houston, Texas 77068
(713) 564-7029

Sponsor is a professional limited liability company and a law firm authorized to practice law in the State of Texas. The attorney responsible for the content of this Promotion is Bryan Joseph Fagan, Owner and Managing Attorney. Principal office: Houston, Texas.

2. The Promotion

The “$2,500 Fresh Start Giveaway” (the “Promotion”) is a sweepstakes decided by random drawing. By entering, you accept and agree to be bound by these Official Rules and by Sponsor’s decisions, which are final and binding on all matters relating to the Promotion.

These Official Rules govern the Promotion specifically. Sponsor’s general Website Terms and Conditions and Privacy Policy also apply to your use of the website. Where these Official Rules and the general Website Terms and Conditions conflict as to the Promotion, these Official Rules control.

3. Promotion Period

The Promotion begins at 12:00:00 AM Central Time on October 1, 2026 and ends at 11:59:59 PM Central Time on October 31, 2026 (the “Promotion Period”). Entries submitted before or after the Promotion Period are not eligible. Sponsor’s entry-system timestamp is the official time-keeping device for the Promotion.

4. Who Can Enter

The Promotion is open only to individuals who, at the time of entry:
  • are legal residents of the United States;
  • are 18 years of age or older; and
  • reside in the State of Texas.

The prize is a credit toward legal services that Sponsor can only provide in Texas. Residents of other states are not eligible to win.

Not eligible to enter or win: attorneys, employees, owners, members, contractors, and agents of Sponsor, and the immediate family members (spouse, parent, child, sibling, and their spouses) and household members of any of them.

If you are already represented by another attorney in a divorce or family law matter, please speak with your own attorney before entering. Sponsor does not solicit clients who are represented by other counsel and does not intend to interfere with any existing attorney-client relationship.

Void where prohibited or restricted by law.

5. How to Enter Online

During the Promotion Period, go to the entry page and complete the entry form in full. The form asks for your first name, last name, email address, telephone number, and Texas county of residence, and requires you to check the box confirming your eligibility and consenting to be contacted about the Promotion.

Your entry is not complete until you schedule a free consultation with Sponsor. After you submit the form, Sponsor will contact you by phone, text message, or email to schedule that consultation, which you may also book yourself using the scheduling link provided. Your entry is included in the drawing once a consultation is scheduled during the Promotion Period. Entries without a scheduled consultation are not entered. The consultation is free and creates no obligation.
All information you submit must be truthful, accurate, and complete. Entries that are incomplete, without a scheduled consultation, falsified, submitted by automated means, or that otherwise do not comply with these Official Rules will be disqualified.
Please do not include confidential details about your legal matter in the entry form. See Section 13.

6. One Entry Per Person

Limit one (1) entry per person for the entire Promotion Period, regardless of how many email addresses or phone numbers you use. Duplicate entries from the same person, email address, or telephone number will result in disqualification of all of that person’s entries. Using any script, bot, or automated system to enter, or entering under a false identity, results in disqualification.

7. Free Mail-In Alternative

You do not need to enter online. To enter by mail, hand-print on a postcard or a single sheet of paper: your full name, mailing address, email address, telephone number, Texas county of residence, and date of birth, along with the statement “I am a Texas resident age 18 or older and I agree to the Official Rules.” Mail it to:

Law Office of Bryan Fagan, PLLC
Attn: Fresh Start Giveaway
3707 Cypress Creek Parkway, Suite 400
Houston, Texas 77068

Mail-in entries must be postmarked by October 31, 2026 and received by November 5, 2026. Mail-in entries count toward the same one-entry-per-person limit in Section 6. Sponsor is not responsible for entries lost, delayed, or misdirected in the mail.

8. The Prize

One (1) prize will be awarded: a credit of two thousand five hundred U.S. dollars ($2,500.00) applied by Sponsor toward attorney’s fees and court filing costs in a Texas divorce matter in which Sponsor is engaged to represent the winner.

Approximate Retail Value of the prize: $2,500.00. Total value of all prizes awarded in this Promotion: $2,500.00.

9. What the Prize Covers — and What It Doesn’t

The credit is applied to Sponsor’s attorney’s fees and to court filing fees in the winner’s divorce matter, up to a total of $2,500.00.

The prize does not cover, and the winner remains responsible for:

  • any fees or costs above the $2,500.00 credit;
  • contested hearings, trial, discovery disputes, appeals, enforcement actions, and modification proceedings;
  • mediation fees;
  • fees for expert witnesses, custody evaluators, amicus attorneys, guardians ad litem, appraisers, private investigators, or process servers;
  • any other professional’s fees, including accountants and financial advisors;
  • travel, childcare, time away from work, or any other personal expense; and
  • any matter other than the single divorce matter for which the prize is awarded.

The prize has no cash value, cannot be redeemed for cash, is non-transferable, and cannot be assigned, sold, gifted, or applied to anyone’s matter other than the winner’s. No substitution is permitted except by Sponsor, which may substitute a prize of equal or greater value if the stated prize becomes unavailable.

10. How the Winner Is Chosen

One (1) potential winner will be selected in a random drawing from all eligible entries received and confirmed by a scheduled consultation during the Promotion Period. The drawing will be held on or about November 1, 2026 by Sponsor or its designated representative, whose decisions are final and binding.

Odds of winning depend on the total number of eligible entries received.

11. Winner Notification and Deadlines

Sponsor will attempt to notify the potential winner by telephone and email, using the contact information submitted with the entry, on or about November 1, 2026.

The potential winner must respond within five (5) business days of the first notification attempt. If the potential winner does not respond in time, the notification is undeliverable, or the potential winner does not meet every requirement of these Official Rules, Sponsor may disqualify that entry and select an alternate winner from the remaining eligible entries.

Before the prize is awarded, the potential winner may be required to sign and return an Affidavit of Eligibility, a Liability Release, and — where lawful — a Publicity Release, within seven (7) days of receiving them.

12. Claiming the Prize: Engagement, Conflicts, and Limits

A written engagement agreement is required. The credit is applied only under a written engagement agreement for legal representation, on Sponsor’s standard terms, signed by the winner and Sponsor before any legal services are provided.

Representation is subject to Sponsor’s professional obligations. Sponsor’s ability to represent the winner is governed by the Texas Disciplinary Rules of Professional Conduct and by Sponsor’s ordinary client intake process, including a conflict-of-interest check. Consistent with those obligations, Sponsor may decline or withdraw from the representation, including where:
  • a conflict of interest exists or later arises — for example, if Sponsor already represents or has represented the winner’s spouse;
  • the matter falls outside Sponsor’s practice areas or outside the Texas courts Sponsor is able to serve;
  • the winner is represented by other counsel who has not withdrawn;
  • the winner does not reside in Texas; or
  • the winner declines to sign an engagement agreement.

If Sponsor cannot represent the winner for any of these reasons, Sponsor may select an alternate winner. No cash or other substitute will be provided in place of the legal-services credit.

The winner is never locked in. Nothing in these Official Rules limits the winner’s right to end the representation at any time, for any reason. If the representation ends before the full credit is used, the unused portion is forfeited and has no cash value.

13. Entering Does Not Make Us Your Lawyers

Entering this Promotion does not create an attorney-client relationship between you and Sponsor. No attorney-client relationship exists unless and until you and Sponsor sign a written engagement agreement.

Information you submit through the entry form is not protected by the attorney-client privilege. Do not send confidential, sensitive, or privileged details about your case through the entry form or by email before an engagement agreement is in place.

The content of the Promotion page and of these Official Rules is general information, not legal advice. No particular result is promised or guaranteed. Prior results do not guarantee a similar outcome; every case is different.
Bryan Joseph Fagan and the attorneys of the Law Office of Bryan Fagan, PLLC are licensed in Texas. Unless a particular attorney’s biography states otherwise, Sponsor’s attorneys are not certified by the Texas Board of Legal Specialization.

14. Taxes

The winner is solely responsible for all federal, state, and local taxes and any other cost associated with receiving or using the prize. Sponsor may require a completed IRS Form W-9 before awarding the prize and may issue an IRS Form 1099 reporting the value of the prize as required by law. Winners should consult their own tax advisor.

15. Publicity — and the Winner’s Right to Privacy

Except where prohibited by law, accepting the prize constitutes the winner’s consent for Sponsor to use the winner’s first name, last initial, and city and county of residence for promotional purposes, in any medium, without additional compensation.
Sponsor will not publicize the substance of the winner’s legal matter and will not disclose confidential client information. The winner may decline to be identified publicly and may decline to appear in any photograph, video, testimonial, or other promotional content without forfeiting the prize.

16. Your Information

Sponsor uses the information you submit to administer the Promotion and, where you have consented, to contact you about the Firm’s services. Sponsor does not sell entrant information. Handling of your information is governed by Sponsor’s Privacy Policy.

You can withdraw consent to marketing contact at any time using the unsubscribe link in any email, or by calling (713) 564-7029. Withdrawing marketing consent does not affect your entry.

17. General Conditions

Sponsor may disqualify any entrant it reasonably believes has violated these Official Rules, tampered with the entry process, acted in a disruptive or abusive manner, or attempted to interfere with the fair operation of the Promotion.
If the Promotion cannot run as planned — because of a computer virus, software or hardware failure, tampering, unauthorized intervention, fraud, or any other cause beyond Sponsor’s reasonable control that affects the administration, security, fairness, or proper conduct of the Promotion — Sponsor may cancel, terminate, modify, or suspend the Promotion and conduct the drawing from the eligible entries received up to the point of that action.
Sponsor is not responsible for lost, late, misdirected, incomplete, garbled, or undeliverable entries or notifications, for technical or network failures, or for any error in administering the Promotion.

18. Release of Liability

By entering, you release Sponsor and its owners, members, attorneys, employees, contractors, and agents from any claim, injury, loss, or damage arising out of your participation in the Promotion or out of accepting, receiving, using, or misusing the prize.

This release does not apply to, and nothing in these Official Rules waives or limits, any duty Sponsor owes to a client under the Texas Disciplinary Rules of Professional Conduct or other applicable law, and does not waive any claim that cannot lawfully be waived.

19. Governing Law and Disputes

These Official Rules are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Promotion will be brought exclusively in the state or federal courts located in Harris County, Texas, and each entrant consents to the jurisdiction and venue of those courts.
To the fullest extent permitted by law, entrants waive any right to claim punitive, incidental, consequential, or indirect damages, and any right to have damages multiplied.

20. Requesting the Winner’s Name

After November 1, 2026, you may request the first name and last initial of the winner by writing to Sponsor at the address in Section 1.

21. Severability

If any provision of these Official Rules is held invalid or unenforceable, that provision will be severed and the remaining provisions will stay in full force and effect.

22. Attorney Advertising

This Promotion and the page describing it are attorney advertising under the Texas Disciplinary Rules of Professional Conduct. Law Office of Bryan Fagan, PLLC is responsible for the content. Principal office: 3707 Cypress Creek Parkway, Suite 400, Houston, Texas 77068. Unless otherwise stated, Sponsor’s attorneys are not certified by the Texas Board of Legal Specialization.
