Legal separation is a concept that provides a middle ground between marriage and divorce. Some states have enacted statutes and enforce laws that allow or even require spouses to legally separate before divorcing. However, Texas does not recognize legal separation. In short, persons in Texas are either married or they are divorced; there is no legal status between the two.
To bridge the gap between marriage and divorce, Texas courts do have broad discretion to enter temporary orders and injunctions that will govern the rights and duties of spouses while their divorce lawsuit is pending.
The closest thing that Texas has in regards to a legal separation would be a suit affecting the parent child relationship. This would allow a couple to get orders in place in regards to children, child support, and visitation without having to get a divorce. However, it would not do anything in regards to a married couple’s property.
