Affidavit of Heirship for a Motor Vehicle

If a loved one of yours has passed away, you may be in a position to have ownership of the vehicle transferred to you. While you may be able to take physical possession of the vehicle immediately it will take some effort to transfer legal ownership to you. The Affidavit of Heirship for a Motor Vehicle is the form that will allow you to do so. Transferring legal ownership is important if you want to sell the vehicle, update the registration for the vehicle or perform any other action associated with the vehicle. Physical possession alone will not allow you to perform any of these actions.

Note that if the deceased owner of the vehicle’s estate has been probated then the executor or administrator may assign the title provided a certified copy of the probate proceedings, Letters Testamentary or Letters of Administration are attached. In that case, you do not need to fill out this form. On the other hand, if there has been no probate of the estate occur then the heirs of the deceased owner’s estate may complete this form and no additional documentation is required. Finally, whomever is the intended transferee of the vehicle ownership must be listed on this form, as well.

Proof of liability insurance for the applicant, title to the vehicle, the will of the deceased owner (if any), the affidavit of heirship for a motor vehicle as well as the application for Texas Title are the documents required to transfer title to a motor vehicle. You can bring these documents to any office for your county tax assessor-collector.
