Child Removal
CPS will only remove children from their household when it’s necessary to protect them from abuse or neglect. They are extremely reluctant to separate children from their families, so removal only happens when there are no reasonable efforts that will keep children safe in their homes.
Whether or not CPS has a court order, they can remove your child from your home if they feel your child is in immediate danger. If this happens, a judge will schedule a hearing within 2 weeks after CPS removes a child. You will need to complete a Child Caregiver Resource Form, which will give CPS the names of at least 3 people, including grandparents and other adult relatives, who might be able to provide care, emotional support, or other support for the child while the parents receive services.
Termination of Parental Rights
Termination of your parental rights is a potential outcome of a CPS case. If the court determines you are a danger to your children, they will formally terminate your rights as a parent. Termination means the parent and child no longer have a legal relationship. However, in order to terminate your rights, a caseworker must consult with the attorney representing CPS against you to ensure there are grounds for termination of your rights.
