The Standard Possession Order

Depending on the home environment and nature of the divorce, there are a different types of parental visitation that the court can order. In Texas, Standard Possession Orders are filed for ex-spouses who cannot agree on a parenting plan. The Standard Possession Order outlines the schedule both parents must follow, but the court can modify the visitation order based on what is in the best interest of the child.

For parents who live within 100 miles of each other, the noncustodial parent has visitation:

  • The first, third and fifth weekends of every month
  • Thursday evenings of each week
  • Alternating holidays
  • Extended periods of time during summer vacation

For parents who live more than 100 miles apart:

  • No mid-week visitation
  • Alternating holidays
  • The noncustodial parent has visitation every spring break and a longer extended period of time in the summer

In cases where the child is very young and has had very little or no previous contact with the noncustodial parent, the court will file a Modified Possession Order. Under this order, noncustodial parents will start off with shorter visits that become longer as time goes on, until the Standard Possession of Order is met.
